1. Agreement to these Terms
These Terms of Use (“Terms”) are an agreement between you and Pay Attention, LLC (“Pay Attention,” “we,” “us,” or “our”). They govern your use of our website, iOS app, waitlist, support, and related services (the “Service”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must be at least 13 to use the Service. To authorize a payment method or financial transaction, you must be at least 18 or the age of legal majority where you live and legally able to enter a binding agreement.
You are responsible for your device, Apple account, account activity, and the accuracy of information you provide. Notify us promptly if you believe your account has been accessed without permission.
3. What Pay Attention does
Pay Attention lets you choose apps, categories, or websites to monitor through Apple’s Screen Time frameworks, set a weekly allowance and accountability rules, view aggregate usage and overage information, and choose nonprofit allocations. The Service is a habit-accountability tool; it is not medical, psychological, financial, tax, or legal advice.
4. Screen Time permission and accuracy
You decide whether to grant Screen Time permission and what to select. You can change or revoke permission in iOS Settings. Usage information depends on Apple frameworks, device availability, time-zone settings, and successful syncing. Delays, incomplete reports, or platform errors may occur. Review your weekly information and contact support if something appears wrong.
5. Accountability amounts, caps, and authorization
Where payment functionality is enabled, the app calculates a weekly amount using completed overage minutes, your chosen rate, and your weekly cap. Your saved settings at the applicable processing time control the calculation. Amounts shown before processing are projections.
Before you authorize payment, the Service will present applicable charge timing, nonprofit allocation, platform share, processing costs, cancellation method, refund rules, and tax-receipt status. You are responsible for reviewing these details and keeping your settings and payment information current.
6. Nonprofit information and tax treatment
Nonprofit names, profiles, and search results may be supplied by third parties. An organization’s appearance does not constitute an endorsement by Pay Attention. We do not provide tax advice or guarantee that any amount is tax-deductible. Consult the receipt made available for a transaction and a qualified tax adviser about your circumstances.
7. Cancellation, refunds, and disputes
You can pause activity tracking, change your plan, manage eligible payment settings, or delete your account in Settings. Changes made after a weekly amount begins processing may apply to the next processing period.
If you believe a charge is incorrect, contact support promptly with the date and amount. Refund eligibility may depend on transaction status, the payment provider’s rules, nonprofit disbursement status, and applicable law.
8. Acceptable use
You may not:
- Use the Service unlawfully, deceptively, or to harm others.
- Attempt to bypass authentication, security, payment safeguards, caps, or usage rules.
- Probe, scrape, reverse engineer, interfere with, or overload the Service except where applicable law expressly permits.
- Use another person’s account or payment method without authorization.
- Misrepresent transaction status, nonprofit relationships, receipts, or tax treatment.
9. Ownership and feedback
Pay Attention and its licensors own the Service, brand, software, design, and content, excluding content owned by Apple, nonprofits, and other third parties. We give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service as intended.
If you provide feedback, you allow us to use it without restriction or payment, provided we do not publicly identify you without permission.
10. Third-party services
The Service relies on third parties such as Apple, Stripe, hosting providers, and nonprofit-data providers. Their terms and privacy practices may apply. We are not responsible for third-party services we do not control.
11. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if reasonably necessary to protect users, prevent abuse, comply with law, address security or operational risk, or enforce these Terms. Sections that by their nature should survive termination will survive.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, Pay Attention and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from the Service. Where liability cannot be excluded, our aggregate liability will not exceed the greater of the amount you paid Pay Attention in the 12 months before the claim or US $100. Applicable consumer law may provide additional rights.
14. Changes
We may change the Service and these Terms. We will update the effective date and provide additional notice when required. Your continued use after revised Terms take effect means you accept them.
